Research on the application of international contract law by China’s enterprises in the conclusion of international trade contract
Introduction
Since the implementation of the opening up policy in China, the stable social economic progress and the frequent foreign trade, in particular, the rapid development of modern communication and information technology has narrowed the distance among nations. The development trend of multiple polarization and economic globalization has created more excellent opportunity for international goods transaction.
The establishment of WTO has made the sales of international goods an important support for the prosperity of global economy. Meanwhile, the growing prosperous sales of international goods have made the international trade contract an important problem for foreign trade enterprise. Usually, the sales contract of international goods has not only regulated the goods, but also the content of the agreement reached after the negotiation of the two parties. This contract is the basis for the success of the international trade. Because of this, in the conclusion of the contract, carefulness and full consideration are quite indispensable. Any meticulous mistake might cause great loss.
With the promotion of unified legislation throughout the whole world, modern unified contract law has shown two characteristics, the multi-polarization of legislative format and the integration of legislative contents.
