QUESTION
Jackson bought a new laptop two months ago worth RM5,000 and now due to some financial constrain he is now badly in need of money so he thought of selling his laptop. His employer, Rashid happened to know about IT, offered to buy the laptop from Jackson for RM2,500 only. Jackson was reluctant in the first place but thinking that his refusal might affect his performance as an employee then he agreed to sell it to Rashid. One week after that his friend Steven offered RM4,000 for the laptop since it was still new and in good condition. He now regrets for agreeing to sell the laptop to Rashid and decided to sell it to Steven by accepting RM1,000 as deposit from Steven.
Rashid is now aware of the agreement between Jackson and Steven, he now wants to bring the case to the court by stating that his earlier contract with Jackson is valid and insist for the laptop to be sold to him. Advise the parties.
LEARNING OUTCOMES
This assignment will assess your ability to:
1. Discuss the formalities and principles governing formation of business contract;
2. Conduct simple directed research into rights and liabilities arising from affairs of business;
3. Analyse the given problem situation and apply legal authorities to provide appropriate solutions; and

TASK
1. You are required to write your answer within the word limit of 1,500 words. This word limit excludes citations and bibliography.
2. In the event the maximum word limit of 1,500 words is exceeded, any part or parts of the answer in excess of the word limit will be disregarded.
3. The following is a general guide as to the report layout:
(a) Introduction: general identification of the legal issues that will be discussed;
(b) Body: elaboration of the legal issues (identified at the “Introduction” stage) and application of those legal issues to assist your client; and
(c) Conclusion: summary of the arguments presented and a persuasive conclusion as to why your client should win this case.
4. Your attention is also drawn to UCTI’s regulations on plagiarism; these regulations apply to this coursework. Any information taken from another source (e.g. lecture notes, text books, Internet sites) must be referenced using the Harvard Referencing method.
5. Please state your word count at the end of your answer.
6. The group report must be submitted together with the Workload Matrix, Group Activity Log and the Peer Assessment Forms.
